Missed the Deadline? You May Still Have Options
Missing an appeal deadline is not ideal, but it doesn't necessarily mean you have no options left. The consequences depend on the type of fine and which deadline you missed.
Council PCN — Late Appeal Options
- Missed informal challenge (14 days): You can still make a formal representation after receiving the Notice to Owner. You lose the early payment discount protection, but your substantive rights remain.
- Missed formal representation (28 days after NtO): This is more serious. However, if you can show you didn't receive the NtO, or had exceptional circumstances preventing a timely response, you may still have grounds.
- Missed TPT appeal (28 days after rejection): The Traffic Penalty Tribunal may accept late appeals in exceptional circumstances at the adjudicator's discretion.
Private Charge — Late Appeal Options
- Missed operator appeal (28 days): Some operators will still consider late appeals. It costs nothing to try — write to them anyway.
- Missed POPLA/IAS escalation (28 days): POPLA and IAS are generally strict on deadlines. However, if you can show you didn't receive the rejection letter or had exceptional circumstances, they may make an exception.
If All Appeals Are Exhausted
If you've missed all deadlines and the case proceeds to court (private) or enforcement (council), you can still defend the case at that stage. For private charges, the court will consider the merits regardless of whether you used the formal appeal process. For council PCNs, you can apply to the court to have a Charge Certificate set aside.
