Debt Collectors — Don't Panic
If a private parking company has passed your case to a debt collection agency, don't panic. Debt collectors sound intimidating but have very limited powers. They are not bailiffs, they have no legal authority to visit your home, and they cannot affect your credit score.
What Debt Collectors CAN Do
- Write to you requesting payment.
- Telephone you to request payment.
- Add their own fees to the amount (though whether these are recoverable is debatable).
What Debt Collectors CANNOT Do
- Enter your property or seize goods (only bailiffs with a court order can do this).
- Affect your credit score (only a CCJ can do this).
- Threaten criminal action (parking charges are civil matters).
- Harass you — they must comply with the Financial Conduct Authority guidelines.
- Add unreasonable fees that are disproportionate to the original debt.
Should You Pay the Debt Collector?
If you have valid grounds for appeal that you haven't yet used, write to the debt collector stating that the charge is in dispute and explain your grounds. Many debt collectors will return the case to the parking company. If you've exhausted all appeals and have no valid grounds, paying may be the pragmatic choice to avoid a potential court claim.
Council PCN Debt Collection
Council PCNs use a different system. Councils use enforcement agents (bailiffs), not ordinary debt collectors. Bailiffs have greater legal powers, including the ability to visit your property. If a council PCN has reached bailiff stage, take it seriously and act quickly.
